🔒 The short version: You can use PhoneRestore on your devices. You can't copy it, reverse-engineer it, or use it to spy on people. We own the software; you own your data.
This End User License Agreement ("EULA") is a legal agreement between you ("User") and Silverplate Partners LLC, doing business as PhoneRestore ("Company," "we," "us") for the PhoneRestore mobile application ("App"). By installing, copying, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the App.
This EULA supplements, and does not replace, the Google Play Terms of Service. In the event of a conflict between this EULA and the Google Play Terms of Service, the Google Play Terms of Service will control to the extent required by Google.
We grant you a limited, non-exclusive, non-transferable, revocable license to:
The iOS companion caregiver app, if applicable, is subject to its own separate terms and license agreement.
You may NOT:
PhoneRestore is designed to be used with the explicit knowledge and consent of the device owner. If you are setting up the App on someone else's device (such as a parent or family member), you represent and warrant that you have obtained their informed consent. Using PhoneRestore on a device without the owner's knowledge is a violation of this EULA and may be illegal.
The iOS companion caregiver app is subject to its own separate terms. If you use the iOS companion app as a caregiver, you are responsible for using any access granted to you in accordance with the device owner's wishes and all applicable laws. Caregiver access must not be used in any manner that exceeds the scope of the consent provided by the device owner.
PhoneRestore requests access to Android's Accessibility Service solely to restore certain device settings (such as WiFi, Bluetooth, and Airplane Mode) that cannot be modified through standard Android APIs. This use complies with Google Play's Accessibility Services Policy.
PhoneRestore's use of the Accessibility Service is limited exclusively to restoring device settings to the user's saved baseline. PhoneRestore does NOT use the Accessibility Service to:
You may disable the Accessibility Service permission at any time in your device settings. Doing so will limit the App's ability to restore certain settings automatically.
PhoneRestore includes a Photo Recovery feature that allows you to view and recover photos that have been moved to your device's trash or recycle bin. By using this feature, you acknowledge and agree that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR FAILED PHOTO RECOVERY ATTEMPTS, PERMANENTLY LOST PHOTOS, OR ANY CONSEQUENCES ARISING FROM THE USE OR INABILITY TO USE THE PHOTO RECOVERY FEATURE.
Blocked Caller Detection: PhoneRestore can monitor your device for changes to the blocked callers list. This feature reads your blocked numbers list locally on your device for comparison against your saved snapshot. This data is not transmitted to our servers.
Deleted App Detection: PhoneRestore monitors the list of installed applications on your device to detect if an app has been removed since your last settings snapshot. The installed app list is stored as part of your settings snapshot and, if caregiver pairing is enabled, synced to our servers to allow your caregiver to view app status remotely.
PhoneRestore is available by paid subscription, processed through the Google Play Store.
The App is licensed, not sold. Silverplate Partners LLC retains all right, title, and interest in and to the App, including all intellectual property rights. Your data (device settings snapshots, account information) remains yours.
We may release updates to the App from time to time. Some updates may be required for continued use. We recommend keeping the App updated for the best experience and security.
The App uses the following third-party services, each subject to their own terms and privacy policies:
We do not control third-party services and are not responsible for their availability, security, or practices.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that:
Android device manufacturers may implement settings differently, which may affect the App's ability to restore certain settings on certain devices.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Silverplate Partners LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, device malfunction, inability to restore settings, or failure to recover photos. Our total liability shall not exceed the amount you paid for the App in the 12 months prior to the claim.
You agree to defend, indemnify, and hold harmless Silverplate Partners LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App in violation of this EULA; (b) your violation of any applicable law; or (c) your infringement of any third-party rights.
This EULA is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and uninstall it from all devices. We may also terminate or suspend your access at our discretion. Termination does not entitle you to a refund of any prepaid subscription fees; cancellation of a subscription is governed by the Google Play cancellation terms.
The App is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you are under 13, you may not use the App. If you are a parent or guardian and believe your child under 13 has used or installed the App, please contact us at legal@getphonerestore.com and we will take appropriate action.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Informal Resolution First. Before filing any legal claim, you and the Company agree to try to resolve the dispute informally. To initiate this process, send a written description of your dispute and the relief you seek to legal@getphonerestore.com. We will attempt to resolve the matter within 30 days of receiving your notice. If the dispute is not resolved within that 30-day period, either party may proceed to arbitration as described below.
Binding Arbitration. If informal resolution fails, you and the Company agree that any dispute, claim, or controversy arising out of or relating to this EULA or your use of the App — including questions about its existence, validity, or termination — will be resolved by binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org). The arbitration will take place in New York County, New York, unless both parties agree in writing to a different location or to proceed by phone or video.
Class Action Waiver. You and the Company each agree to resolve disputes only on an individual basis. You waive the right to bring or participate in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this waiver is found unenforceable, then the agreement to arbitrate shall not apply to that dispute.
Small Claims Court Carveout. Either party may bring an individual claim in small claims court in New York County, New York (or the small claims court serving your location, if you are not in New York), provided the claim qualifies under that court's jurisdictional and procedural requirements.
Opt-Out Right. You may opt out of this arbitration agreement within 30 days of the first date you use the App by emailing legal@getphonerestore.com with the subject line "Arbitration Opt-Out" and including your full name and email address. If you opt out, disputes will be resolved in court as set forth in the Governing Law section, but the Class Action Waiver above will still apply. Opting out will not affect any other rights or obligations under this EULA.
Exceptions. Nothing in this section limits either party from seeking emergency injunctive or other equitable relief in court to prevent irreparable harm pending arbitration, or from bringing claims related to intellectual property infringement or misappropriation in court.
This EULA shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts located in New York County, State of New York, or if federal jurisdiction applies, the United States District Court for the Southern District of New York.
This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and Silverplate Partners LLC with respect to the App and supersedes all prior agreements, understandings, and negotiations. If any provision of this EULA is found to be unenforceable, the remaining provisions will remain in full force and effect.
We may update this EULA from time to time. If we make material changes, we will notify you through the App or by other means. Continued use of the App after changes constitutes acceptance of the updated EULA.
