By using PhoneRestore ("the App") or visiting getphonerestore.com ("the Website"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our services.
These Terms are between you and Silverplate Partners LLC, doing business as PhoneRestore ("we," "us," "our").
PhoneRestore is an Android application that:
PhoneRestore modifies device settings only. The Photo Recovery feature accesses your device's local media trash to display recoverable photos, but does not upload or store any photos on our servers. It does not modify your personal content (messages, contacts, etc.).
You must be at least 13 years old to use PhoneRestore. If you are setting up PhoneRestore on behalf of another person (e.g., a parent or family member), you represent that you have their consent to do so. To purchase a subscription, you must meet the minimum age required by Google Play in your country to enter into a binding agreement.
PhoneRestore allows users to pair with a "caregiver" who can:
Caregiver pairing requires explicit consent from the device owner. The device owner can revoke caregiver access at any time. Caregivers agree to use this access responsibly and only for the purpose of helping the device owner. The iOS companion caregiver app is a separate application subject to its own terms. Caregivers are responsible for using their remote access in accordance with the device owner's explicit wishes and applicable law.
If you create an account, you are responsible for keeping your login credentials secure. You are responsible for all activity under your account. Please notify us immediately if you suspect unauthorized access.

PhoneRestore requires certain Android permissions to function. We request only permissions necessary for the App's core features. Each permission is explained during setup, and you can review them in your device's settings at any time. Key permissions include:
The Photo Recovery feature allows you to view and recover photos from your device's trash or recycle bin. Important terms for this feature:
Blocked Caller Detection monitors changes to your device's blocked callers list. This feature reads your blocked numbers locally on-device only; this data is not transmitted to our servers.
Deleted App Detection monitors your installed app list and alerts you (and your caregiver, if enabled) when an app has been deleted. The installed app list is part of your settings snapshot and may be synced to our servers if caregiver pairing is enabled.
We aim to keep PhoneRestore available at all times, but we do not guarantee uninterrupted service. We may release updates to improve functionality, fix bugs, or address security issues. We recommend keeping the App updated.

PhoneRestore is available by paid subscription, processed through the Google Play Store.
PhoneRestore is provided "as is" and "as available." We do our best to make it reliable, but:
To the maximum extent permitted by law, Silverplate Partners LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
You agree to defend, indemnify, and hold harmless Silverplate Partners LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of PhoneRestore in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party rights.
You can stop using PhoneRestore at any time by uninstalling the App and deleting your account. We may suspend or terminate your access if you violate these Terms. Upon termination of your subscription, your access to paid features will end at the conclusion of the current billing period. Upon termination, your data will be deleted per our Privacy Policy.
We may update these Terms from time to time. If we make significant changes, we will notify you via the App or email. Continued use after changes constitutes acceptance of the updated Terms.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Informal Resolution First. Before filing any legal claim, you and the Company agree to try to resolve the dispute informally. To initiate this process, send a written description of your dispute and the relief you seek to legal@getphonerestore.com. We will attempt to resolve the matter within 30 days of receiving your notice. If the dispute is not resolved within that 30-day period, either party may proceed to arbitration as described below.
Binding Arbitration. If informal resolution fails, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of PhoneRestore — including questions about their existence, validity, or termination — will be resolved by binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org). The arbitration will take place in New York County, New York, unless both parties agree in writing to a different location or to proceed by phone or video.
Class Action Waiver. You and the Company each agree to resolve disputes only on an individual basis. You waive the right to bring or participate in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this waiver is found unenforceable, then the agreement to arbitrate shall not apply to that dispute.
Small Claims Court Carveout. Either party may bring an individual claim in small claims court in New York County, New York (or the small claims court serving your location, if you are not in New York), provided the claim qualifies under that court's jurisdictional and procedural requirements.
Opt-Out Right. You may opt out of this arbitration agreement within 30 days of the first date you use the App by emailing legal@getphonerestore.com with the subject line "Arbitration Opt-Out" and including your full name and email address. If you opt out, disputes will be resolved in court as set forth in the Governing Law section, but the Class Action Waiver above will still apply. Opting out will not affect any other rights or obligations under these Terms.
Exceptions. Nothing in this section limits either party from seeking emergency injunctive or other equitable relief in court to prevent irreparable harm pending arbitration, or from bringing claims related to intellectual property infringement or misappropriation in court.
These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in New York County, State of New York, or if federal jurisdiction applies, the United States District Court for the Southern District of New York.
These Terms, together with the EULA and Privacy Policy, constitute the entire agreement between you and Silverplate Partners LLC with respect to PhoneRestore. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
