Terms of Service

1. Agreement

By using PhoneRestore ("the App") or visiting getphonerestore.com ("the Website"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use our services.

These Terms are between you and Silverplate Partners LLC, doing business as PhoneRestore ("we," "us," "our").

Please read Section 19 (Dispute Resolution & Arbitration) carefully. It requires that most disputes be resolved by individual binding arbitration and waives your right to participate in a class action, unless you opt out within 30 days as described in that section.

2. What PhoneRestore Does

PhoneRestore is an Android application that:

PhoneRestore modifies device settings only. The Photo Recovery feature accesses your device's local media trash to display recoverable photos, but does not upload or store any photos on our servers. It does not modify your personal content (messages, contacts, etc.).

3. Eligibility and Capacity

You must be at least 13 years old to use PhoneRestore. To purchase a subscription, you must meet the minimum age required by Google Play in your country to enter into a binding agreement.

Setting Up the App for Another Person. If you are setting up PhoneRestore on behalf of another person (for example, a parent, spouse, or family member), you represent and warrant that:

Capacity to Agree. If the intended user of the App lacks legal capacity to enter into these Terms (for example, due to cognitive impairment), the App may only be set up by a person with appropriate legal authority to act on their behalf. PhoneRestore is not a substitute for legally established guardianship, power of attorney, conservatorship, or similar arrangements. We do not verify legal capacity or authority and rely on the representations of the person setting up the App.

4. Caregiver Features

PhoneRestore allows a device owner ("Senior User") to pair with another person ("Caregiver") who can:

Senior User Rights. The Senior User always retains primary control of the device and the account. The Senior User may revoke caregiver access at any time, from within the App, without notifying or seeking approval from the Caregiver.

Caregiver Responsibilities. By using caregiver features, the Caregiver agrees that they will not:

Caregiver Acknowledgments. Caregivers acknowledge that they may have independent legal obligations under elder protection laws, mandatory reporting laws, or similar statutes in their jurisdiction, and that PhoneRestore does not satisfy or replace those obligations.

Companion iOS App. The iOS companion caregiver app is a separate application subject to its own terms and the Apple-specific terms in Section 13.

5. Your Account

If you create an account, you are responsible for keeping your login credentials secure. You are responsible for all activity under your account. Please notify us immediately at security@getphonerestore.com if you suspect unauthorized access.

PhoneRestore requires certain Android permissions to function. We request only permissions necessary for the App's core features. Each permission is explained during setup, and you can review them in your device's settings at any time. Key permissions include:

The Photo Recovery feature allows you to view and recover photos from your device's trash or recycle bin. Important terms for this feature:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR FAILED PHOTO RECOVERY ATTEMPTS, PERMANENTLY LOST PHOTOS, OR ANY CONSEQUENCES OF RECOVERED CONTENT, INCLUDING EMOTIONAL DISTRESS, RELATIONSHIP HARM, OR DISPUTES OVER CONTENT OWNERSHIP.

9. Blocked Caller & Deleted App Detection

Blocked Caller Detection monitors changes to your device's blocked callers list. This feature reads your blocked numbers locally on-device only; this data is not transmitted to our servers.

Deleted App Detection monitors your installed app list and alerts you (and your caregiver, if enabled) when an app has been deleted. The installed app list is part of your settings snapshot and may be synced to our servers if caregiver pairing is enabled.

10. Availability & Updates

We aim to keep PhoneRestore available at all times, but we do not guarantee uninterrupted service. We may release updates to improve functionality, fix bugs, or address security issues. We recommend keeping the App updated. We may also discontinue features with reasonable advance notice.

PhoneRestore uses the following third-party services to operate, each subject to their own terms and privacy policies:

12. Pricing & Subscriptions

PhoneRestore is available by paid subscription, processed through the Google Play Store.

California Subscribers. If you reside in California, you have rights under California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.). You may cancel your subscription at any time through the Google Play cancellation flow referenced above, or by contacting us at legal@getphonerestore.com. We will acknowledge cancellation requests received directly by us within a reasonable time.

13. Apple App Store Terms (Companion iOS App)

If you download or use the iOS companion caregiver app from the Apple App Store, the following additional terms apply, in addition to and not in lieu of the rest of these Terms:

PhoneRestore is provided "AS IS" and "AS AVAILABLE." We do our best to make it reliable, but:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SILVERPLATE PARTNERS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply only to the extent permitted by law.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVERPLATE PARTNERS LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, LOST PHOTOS, BUSINESS INTERRUPTION, OR EMOTIONAL DISTRESS) ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Exceptions. Nothing in these Terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) gross negligence or willful misconduct; or (iv) any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Silverplate Partners LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of PhoneRestore in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any third-party rights; (d) your use of caregiver features in violation of Section 4; or (e) any content you recover, share, or use in connection with the Photo Recovery feature.

17. Termination

You can stop using PhoneRestore at any time by uninstalling the App and deleting your account. We may suspend or terminate your access if you violate these Terms, in our reasonable discretion and (where practicable) with prior notice.

Data Export Before Termination. Before deleting your account, you may request an export of your data by emailing privacy@getphonerestore.com. We will provide your data in a structured, machine-readable format within 30 days of the request, as further described in our Privacy Policy.

Effect of Termination. Upon termination of your subscription, your access to paid features will end at the conclusion of the current billing period. Upon account deletion, your data will be deleted per our Privacy Policy. Sections that by their nature should survive termination — including Sections 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), 19 (Dispute Resolution), and 20 (Governing Law) — will survive.

18. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via the App or email and update the "Last Updated" date at the top of this page. Material changes will take effect no sooner than 30 days after notice, except where a shorter period is required by law or to address a security issue. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App before they take effect.

19. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and your right to participate in a class action.

19.1 Informal Resolution First

Before filing any legal claim, you and the Company agree to try to resolve the dispute informally. To initiate this process, send a written description of your dispute and the relief you seek to legal@getphonerestore.com. We will attempt to resolve the matter within 30 days of receiving your notice. If the dispute is not resolved within that 30-day period, either party may proceed to arbitration as described below. The 30-day informal resolution period is a precondition to either party initiating arbitration.

19.2 Binding Arbitration

If informal resolution fails, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of PhoneRestore — including questions about their existence, validity, or termination — will be resolved by binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (available at www.adr.org). The arbitration will take place in New York County, New York, unless both parties agree in writing to a different location or to proceed by phone or video. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

19.3 Class Action Waiver

You and the Company each agree to resolve disputes only on an individual basis. You waive the right to bring or participate in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to a particular claim or for a particular form of relief, then the agreement to arbitrate shall not apply to that claim or relief, and that claim or relief will proceed in court as set forth in Section 20; the remainder of this Section 19 will continue to apply.

19.4 Mass Arbitration Coordination

If 25 or more similar arbitration demands are filed against the Company by or with the assistance of the same law firm or coordinated group of counsel within a 90-day period, the parties agree that such demands will be treated as a "mass arbitration." In a mass arbitration, the parties will work with AAA to select an efficient batching and bellwether procedure to resolve representative claims first, with the results applied (where appropriate) to remaining claims. Filing fees and arbitrator compensation for mass arbitrations will be allocated in accordance with AAA's mass arbitration supplementary rules then in effect. This provision is intended to ensure orderly and economical resolution of large numbers of similar claims and does not waive either party's right to individual arbitration.

19.5 Small Claims Court Carveout

Either party may bring an individual claim in small claims court in New York County, New York (or the small claims court serving your location, if you are not in New York), provided the claim qualifies under that court's jurisdictional and procedural requirements.

19.6 Opt-Out Right

You may opt out of this arbitration agreement within 30 days of the first date you use the App by:

If you opt out, disputes will be resolved in court as set forth in Section 20, but the Class Action Waiver in Section 19.3 will still apply. Opting out will not affect any other rights or obligations under these Terms.

19.7 Exceptions

Nothing in this section limits either party from: (a) seeking emergency injunctive or other equitable relief in court to prevent irreparable harm pending arbitration; (b) bringing claims related to intellectual property infringement or misappropriation in court; or (c) reporting any matter to a regulatory or law enforcement authority.

20. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration under Section 19, any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in New York County, State of New York, or if federal jurisdiction applies, the United States District Court for the Southern District of New York. Nothing in this section limits the rights of EU/EEA, UK, or California users to seek relief under their applicable local laws where such rights cannot be waived by contract.

21. Copyright and DMCA Notice

We respect intellectual property rights and ask our users to do the same. If you believe that content accessible through PhoneRestore infringes your copyright, please send a notice to our designated DMCA agent that includes the following information required by 17 U.S.C. § 512(c)(3):

We may terminate the accounts of users we determine, in our reasonable discretion, to be repeat infringers.

22. Miscellaneous

Entire Agreement. These Terms, together with the EULA and Privacy Policy, constitute the entire agreement between you and Silverplate Partners LLC with respect to PhoneRestore and supersede any prior agreements.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of these Terms will remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. No waiver will be effective unless in writing and signed by an authorized representative.

Assignment. You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms or any of our rights or obligations under them without restriction. Any attempted assignment in violation of this section is void.

Force Majeure. We will not be liable for any failure or delay in performance to the extent caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, civil unrest, government action, pandemic, labor disputes, internet or telecommunications failures, or third-party service outages.

Notices. We may provide notices to you through the App, by email to the address associated with your account, or by posting on the Website. You may provide notices to us at legal@getphonerestore.com or the mailing address in Section 23.

Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and us.

Headings. Section headings are for convenience only and do not affect interpretation.
